I am opening this arbitration regarding an unpaid €2,500 payout.
The agreement was clear. The other party explicitly stated:
“Send 5k and I'll pay you out.”
I then sent a total of €5,000 as requested. We also discussed the €2,500 payout structure beforehand.
After receiving the funds, the other party confirmed that the money was being sent for withdrawal and stated:
“Please wait, I'll pay you everything tomorrow.”
The key point is that the €5,000 was received and withdrawn/cashed out from the drop account. The agreed transaction was therefore completed from my side.
After that, the explanation for non-payment changed. First, the issue was that he did not have the money available to pay me. He then explained that he had decided to use a new method/service to buy crypto, that the funds were being held there, and that part of the €5,000 had allegedly been returned to the drop. He subsequently stated that his money had been frozen in Germany.
He also started questioning whether there had been a chargeback. I dispute this completely. There was no chargeback of the €5,000 transaction. In fact, the conversation itself shows that the discussion was about what happened to the funds after they had already been withdrawn from the drop account, including the transfer to Zen and the alleged return of €2,000.
Most importantly, there was never an agreement that my payout would depend on whether his later exchange, bank or crypto provider successfully processed his funds. The agreement was that I send the €5,000 and receive my 50% share after the funds were withdrawn/cashed out.
He even stated that his payment method was based on cash withdrawal, while I clearly stated that the agreement was €5,000 sent and withdrawn from the drop = my 50% payout.
His decision to test a new exchange/service after receiving and cashing out the funds is his own responsibility. I cannot be made responsible for funds becoming frozen or delayed at a service he chose to use afterwards.
If you do not have sufficient funds available to honor the agreed payout, you should not take the transaction and then transfer the funds into a new service with the intention of buying crypto. The risk created by that decision cannot be transferred to me.
I therefore request the agreed €2,500 TRX payout, representing my 50% share of the €5,000 transaction.
